Captive Insurance
As a risk manager, you may view captive insurance as an attractive alternative to the traditional commercial insurance market. You may see it as a strategy to reduce or stabilize overall cost; you may view it as a means of accessing the increased capacity available through reinsurance; or maybe you simply want to exert control and limit your exposure to the vagaries and cycles of the insurance market.
Whatever the reason, the question remains: whom do you rely on to help you navigate the complexities and intricacies of the preliminary planning, formation, and licensure of a captive? Who will be your steadfast ally as you contend with legal requirements, compliance, and regulatory issues? Will you feel confident that someone you trust is by your side every step of the way as you confront policy and reinsurance agreement development and review, security arrangements, and coverage analyses?
The captive insurance team of Paul Frank + Collins has the depth and breadth of experience to successfully guide its clients through the entire spectrum of captive formation and maintenance. With expertise in multiple industries and experience with virtually every type of captive, we provide a complete range of legal services to insurers. Captive representation by Paul Frank + Collins means having, not just a lawyer, but a team of seasoned, responsive attorneys who specialize in alternative risk solutions dedicated to your success. Paul Frank + Collins provides captive representation to a robust list of clients, many of whom have grown and evolved with us, developing sophisticated and diverse insurance programs. Several of our clients are Fortune 500 companies with captives in Vermont, South Carolina, and or Arizona. Additionally we provide counsel to a number of midsized clients and group captives. All told, we represent approximately one-third of all captives domiciled in Vermont.
Paul Frank + Collins has practiced captive insurance law since 1981 when the Vermont Legislature created the Vermont captive domicile. From the very beginning, the firm has been devoted to establishing and maintaining Vermont as the world’s premier onshore captive domicile. To this end, we have been instrumental in drafting and lobbying for several key pieces of legislation, including the 1991 redomestication statute, which facilitates the redomiciling of captives both to and from Vermont.
