Mr. Kennedy is a member of the Litigation and Insurance & Claims Consulting teams at Paul Frank + Collins. He practices in the areas of business litigation and insurance law. Prior to joining PF+C, Mr. Kennedy was an associate at Duane Morris in San Francisco where, among other things, he was a member of a team representing London Market insurers in various matters involving insurance coverage and business disputes. Mr. Kennedy is a 2003 graduate of the University of California, Hastings College of the Law and a 1999 graduate of the University of Vermont. During law school, Mr. Kennedy served as a full-time extern for the Honorable John E. Munter (Complex Civil Litigation Department Judge) of the San Francisco Superior Court in the fall of 2002. Mr. Kennedy is admitted to practice in California and admission via waiver is pending in the Commonwealth of Massachusetts. Mr. Kennedy has participated in the following representative matters:
• Airis v. City and County of San Francisco, Case No. CIV 448274, San Francisco Superior Court – Achieved plaintiff's jury verdict in June 2007 trial in favor of world’s largest air cargo developer arising from planned quarter-billion dollar air cargo facility at SFO. The verdict against the city was based on a unanimous jury finding that the city’s airport staff breached its contract duties under an Airport Commission-awarded exclusive negotiation agreement by unfairly interfering with the approval process before the San Francisco Board of Supervisors. (On appeal.)
• PeopleData v. Yahoo!, Inc., Case No. 1-05-CV-038151, Santa Clara Superior Court – Representation of Yahoo! in defense of breach of “pay-per-click” advertising contract and various related tort claims and prosecution of cross-complaint for successor liability and fraudulent conveyance of business assets. Case settled on terms favorable to client. • Yahoo! Search Marketing Group v. PeopleData, Case No. BC 340431, Los Angeles Superior Court – Drafted and argued successful $300,000 pre-judgment attachment motion for Yahoo! against PeopleData (now ZabaSearch). Case settled on terms favorable to client. • Hool and Meeker v. Village Roadshow Limited, Case No. BC 297487, Los Angeles Superior Court – Representation of independent movie producers in fraudulent conveyance action against entertainment industry conglomerate based on transfer of business and employees of a corporate subsidiary following arbitration award and judgment, which with interest totaled $40 million. Case settled on terms favorable to client after defeating summary judgment motions and within one month of trial. Mr. Kennedy is a dual citizen of the United Kingdom and the United States. He lives in Winooski, Vermont with his wife, Vanessa and daughter, Viviana. He is an avid ice hockey and tennis player and alpine skier.
