As an Associate with Paul Frank + Collins, Mr. Pocius utilizes his education and hands-on experience with both the Judiciary and environmental organizations.

Prior to joining Paul Frank + Collins, Mr. Pocius was a Judicial Law Clerk with the State of Vermont Trial Courts, a clerk with the Office of the Vermont Attorney General, and an intern for both Earthjustice in Seattle, Washington and the Vermont Supreme Court. Dave also worked with the Nantucket Conservation Foundation, participated in a Lesser Long-Nosed Bat Foraging Ecology Study at the University of Arizona, and examined the relationship between Alzheimer’s disease and brain physiology while working at Johns Hopkins University in Baltimore, Maryland.

At Paul Frank + Collins, Mr. Pocius's practice focuses on land use and tort law. He maintains an active practice in the state and federal courts of both Vermont and New York and has participated in the following representative matters:

  • Pacific Aeromotive Corp. v. Chrison Aerospace LLC., et al. Docket No. 2:06-CV-249. Dispute between partners in business ventures to salvage, return to service, or sell two Airbus cargo planes and engines located in Baghdad, Iraq, Jeddah, Saudi Arabia and Karachi, Pakistan. (Settled)

  • Estate of Oliver Miller v. Goodyear Tire and Rubber Co. Docket No. 354-02, Chittenden Superior Court. Defense of wrongful death claims against tire manufacturer in state court. (Pending)

  • In re Champlain College, Maple Street Dormitories. Docket No. 145- 7-05, Vermont Environmental Court. An appeal of permits for the construction and renovation of new dormitories on Champlain College’s Burlington campus. (Permit granted).

  • Linda DeLuke et al. v. Total Transportation of Mississippi LLC, et al. Docket No. 05-cv-1443, Northern District of New York. Defense of an international trucking company against claims arising from an accident on the New York State Thruway. (Pending)

  • AnnMarie Hauge, et al v. Schwan’s Home Service Inc., et al. Index No. 9114-04, Supreme Court in the County of Columbia, New York. Defense of permanent injury claims against delivery service. (Dismissed pursuant to Motion for Summary Judgment).
