For over 15 years Matt has focused his practice primarily on the insurance industry, with an emphasis on insurance coverage. He regularly advises insurers on a broad range of coverage issues arising under CGL, commercial property, E&O, D&O, and specialty lines insurance policies. Matt also represents insurers in declaratory judgment, breach of contract, rescission, and bad faith actions in state and federal courts, as well as in commercial arbitration. These matters include both first-party and third-party insurance disputes.

Matt’s clients include traditional domestic insurers, London market insurers, captives, and risk retention groups. He regularly provides coverage opinions on complex coverage matters as well as recommendations on claims handling and claims investigation issues.    

Matt also has experience representing insured defendants in a variety of third-party liability actions, including premises liability, professional liability, and construction defect matters.

Matt is a member of the Insurance Services and Litigation teams at PF+C, where he also serves as the firm’s in-house insurance and loss prevention consultant.

Representative Matters

Obtained summary judgment for Lloyd’s syndicates in coverage dispute under developer’s  general liability policy for indemnity of construction defect claim

Represented Lloyd’s syndicates in action litigating coverage under sporting club’s general liability policy for defense and indemnity of lead exposure and lead poisoning claims, which resulted in favorable settlement

Defended first-party insurer in breach of contract and bad faith lawsuit involving water loss and property damage claims, obtaining favorable settlement

Obtained judgment on motion to dismiss for risk retention group on enforceability and applicability of policy’s arbitration clause

Represented third-party insurer against complaints by insured to state insurance department, obtaining dismissal of same

Obtained summary judgment for worker’s compensation carrier confirming statutory lien rights and defeating breach of contract and extra-contractual claims

Represented life insurer in interpleader action in dispute over life insurance proceeds; negotiated resolution among interested parties
